VAT Receipt From a Non-VAT Payer in Poland: Why You Can’t Deduct It and How to Check the VAT White List

A receipt or invoice that shows VAT does not automatically let you deduct that VAT.
The seller must be an active VAT taxpayer (czynny podatnik VAT) — and you can check that in about a minute on Poland’s VAT white list (biała lista VAT).

Below is a real case from our accounting practice and a step-by-step guide for business owners in Poland.

A real case: a VAT receipt that couldn’t be deducted

I was entering a client’s expenses for the previous month. One document — a fiscal receipt with the buyer’s tax number (paragon z NIP) — showed 23% VAT. The accounting software refused to accept the input VAT: the seller was not an active VAT taxpayer.

It got worse. By law, this seller’s services cannot be sold VAT-free: the small-business VAT exemption does not apply to them.

Software can be wrong, and the tax office sometimes removes a business from the register by mistake. So I checked the seller myself on the white list. The result was a surprise: the company had never been registered for VAT, yet it was issuing receipts with VAT. Digging further, I found its books were kept by an outside accounting office that had missed the error.

Why the VAT on such a receipt can’t be deducted

  • Right to deduct: only an active VAT taxpayer can deduct input VAT, and only from a document issued by a seller entitled to charge VAT. A receipt with the buyer’s NIP up to PLN 450 gross counts as a simplified invoice (faktura uproszczona), so the same rules apply.
  • Tax office position: Polish tax authorities usually deny deductions on invoices from unregistered sellers, citing Article 88(3a) of the VAT Act.
  • Court position: Polish administrative courts and the CJEU sometimes allow the deduction if the transaction was real and the buyer exercised due diligence. That means a dispute, not a guarantee.
In practice: we do not deduct VAT from such a document. The expense is booked as a tax-deductible cost at its gross amount, provided it relates to the business.

How to check a supplier on Poland’s VAT white list in 4 steps

  1. Open the Wykaz podatników VAT search on podatki.gov.pl.
  2. Enter the seller’s NIP, REGON or bank account number.
  3. Check the status — “Czynny” (active), “Zwolniony” (exempt), “Niezarejestrowany” (not registered) or “Wykreślony” (removed) — and the registration or removal date.
  4. Save the confirmation (PDF or request ID). It proves your due diligence in a tax audit.
Check every new supplier and anyone you pay more than PLN 15,000 gross. Paying to an account not on the white list can cost you the expense for income tax purposes and make you jointly liable for the seller’s VAT.

Who must charge VAT even with low turnover

  • Exemption threshold: from 1 January 2026 the small-business VAT exemption limit is PLN 240,000 of annual sales (PLN 200,000 in 2025). Below it, a business may stay unregistered for VAT.
  • Exclusions: Article 113(13) of the VAT Act removes the exemption for certain activities regardless of turnover — for example legal and advisory services, jewellery services and sales of some excise goods.
Result: a business providing such services must register as an active VAT taxpayer from its first sale.

What the seller risks

  • Article 108(1) of the VAT Act: anyone who issues an invoice showing VAT must pay that VAT — even without registration.
  • Tax arrears: VAT on all sales that should have been taxed from the start, plus late-payment interest.
  • Fiscal penal liability under the Fiscal Penal Code for failing to register and failing to pay the tax.
The longer the error lasts, the bigger the bill. Fixing it takes an accountant: filing VAT-R, correcting documents and, where possible, filing a voluntary disclosure (czynny żal).

Receipts with NIP in 2026 and 2027: what changes

  • Until 31 December 2026, a receipt with the buyer’s NIP up to PLN 450 gross remains a simplified invoice and is issued outside KSeF, Poland’s national e-invoicing system.
  • From 1 January 2027, a receipt with NIP is no longer an invoice, whatever the amount. To deduct VAT you will need an invoice in KSeF.
With KSeF the tax office sees invoices in real time, so errors like this will surface faster.

Checklist: you received a VAT document from a non-VAT payer

  1. Don’t deduct the VAT until the seller’s status is clear.
  2. Check the seller on the white list and save the confirmation.
  3. Tell the seller about the error — they may not know.
  4. Ask for a corrected document: without VAT, or issued after the seller registers.
  5. If deduction isn’t possible, book the expense at its gross amount.
  6. For regular suppliers, recheck their status at least once a quarter.

How the story ended

I contacted the owner of the business that issued these receipts and explained the consequences. Today we keep his books. He can be confident his taxes are calculated and paid correctly.

The lesson is simple: an accountant who checks your counterparties protects not only you, but your business partners too.
